Complementary Law No. 26, created in September 11th, 1975 unified the PIS (Social Integration Program and Pasep (Civil Servant Asset Formation Program).

This law, first regulated by Decree No. 78.276/1976, is currently managed by Decree No. 4.751 of June 17, 2003.

Until 04/10/1988, employers could make the contributions received by PIS/Pasep, which were then distributed to workers, through quotas proportional to salary and length of service.

After that date, in 1988, PIS/Pasep no longer received individual contributions, which was changed by art. 239 of the Federal Constitution, also changing the destination of contributions made through PIS/Pasep.

The PIS/Pasep fund aims to raise resources to contribute to the well-being of salaried workers in the public and private sectors. The fund supports the Salary Allowance.

Nowadays, the resources collected by PIS/Pasep are stored and maintained by the FAT (Worker Support Fund), the body responsible for paying for Unemployment Insurance, the Salary Allowance and financing the BNDES (Economic Development Programs by the National Bank for Economic and Social Development).

Who is eligible to receive PIS/Pasep?

Brazilian citizens must meet some requirements to be entitled to receive PIS/Pasep. Are they:

  • Be registered for at least 5 years;
  • Have a formal contract of at least 30 days in the base year (2020);
  • Having received an average of up to 2 minimum wages during this period.

What identification documents are required for withdrawal?

• ID card;
• Driver's License (new model);
• Employee Card recognized by Decree;
• Military ID;
• Foreigners Identity Card;
• Passport issued in Brazil or abroad.

Addenda

Provisional measure No. 946 of April 07, 2020, extinguished the PIS/Pasep Fund for the public servers, with this balance being transferred to the FGTS (Service Time Guarantee Fund).

Federal, state and municipal public servants and employees of public companies and mixed-economy companies are registered with PASEP.

Banco do Brasil, where public servants previously consulted the Pasep, transferred it to the FGTS and withdrawals relating to the Pasep must be made in the FGTS by CEF.

Banco do Brasil continues to make Salary Allowance payments to workers enrolled in the program.
